Once the new system is introduced, what should be the actual tasks performed by the judicial scrivener?
|
Mr. Iwasawa
I basically divide them into three categories: 1) traditional work, 2) newly created tasks and 3) related tasks.
[1]Traditional work
Traditional work consists primarily of documentation, which is basically paperwork such as
drafting complaints, preparation of applications,
registration regarding guardianship, etc. Complaints to
family court follow a relatively simple format these days
and as such really constitute professional work, and one can
not charge much in they way of fees either. Judicial
scriveners must develop more value-added services.
[2]Newly created tasks
Supervision of guardianship is a new
task. When it is a voluntary contract, the scrivener drafts
the contract instrument and assists contractors in the
actual execution of the contents. Supervision of the
application for home care insurance may fall into the
tasks performed by the guardian.
[3]Related tasks
Certain derivatives of guardianship
may be included, such as attorney at guardianship, asset
management, drafting of wills, etc.
In the wake of these new roles, can you think of any particular points that need to be considered at the beginning?

Mr. Iwasawa
Traditional tasks vested for judicial scriveners are rather routine and easily
categorized into certain patterns. Registration work, for
instance, is very diverse and yet they have essentially the same
format. On the other hand, the work required in dealing with the
guardianship system may be very individually specific, which
will also require highly individualistic measures The scriveners
will have to become very flexible to meet such quantum
leap. Ecology means living with nature. Guardianship means
to live with one particular individual. The tasks demanded in
implementing such concepts require much more humane and
personal approaches as compared to the traditional business-like
nature of the work conducted by scriveners.
