Preparedness of the Association of Judicial Scriveners


The Guardianship System Law bill was sent to the Upper House where it has been continued to the next term. What do you expect from the next session of the Diet?

    Last year, we expected the bill to be taken up first thing and approved in the current session. Some rather crucial issues saturated this session from its beginning and the bill was not taken up until late June. The Association began preparations to meet every need which might be required once the law is enacted, establishing guardianship legal support center as a public corporation (See Footnote 2). The Association had completed basic preparations and if the Diet had passed the bill by July or August, we were ready to process notarized certifications for guardianship contractors. Yet, we are still catching up in terms of details and the practical handling of the preparation of application formats and registration procedures among judicial scriveners, assuming that the Supreme Court will promulgate the law and the implementation takes place in April next year.
    Footnote 2: Adult Guardianship and Legal Support Center
    This is an organization which the Association of the Judicial Scriveners has been trying
    to establish. The Center is expected to train and supervise caretakers, supervise care, undertake asset management, conduct actual guardianship implementation as a corporation, organize and conduct seminars sending lecturers to various meetings, provide comprehensive insurance and other guardianship activities.


Let us hear more about the Guardianship Legal Support Centers to be established by the Association.

    Fortunately, there is an excellent coordination effort nationwide for this project, although we must admit that there are some technical problems that need to be solved in providing legal support. For instance, we need to determine the nature of the relationship between headquarters and branch offices. The question is how to make the branch offices that have been contact points for many years into more independent units. Another problem is the decision-making procedures, which we feel require step- by- step solutions as we face concrete cases day by day.
