The Responsibility of Private Organizations to Promote Mutual Understanding By Assisting In Training for Legal Technical Assistance Others

The Content of the Project


We have cooperated with the Japanese government in drafting the Civil Law and Civil Procedural Law for Cambodia. The span of the project is expected last for two to three years. Its purpose is to write a final draft suitable for Cambodia with the cooperation of Japanese government. Subsequently, we have accepted to act as the executive office for the project.
The Foundation also supports the operation of a backup research team composed of academics.

In order to write the draft, two teams have been created: a committee for civil law and a committee for civil procedural law. The chairman of the committee for the civil law is Professor Akio Morishima of Sophia University who has been involved in Vietnam's and Cambodia's legal technical assistance in the past. The chairman of the civil procedural law committee is Professor Morio Takeshita, president of the University of Suruga and professor emeritus of the University of Hitotsubashi. The committee convenes once or twice a month. We also provide space and facilitate operations as an executive office. Additionally, we act as a liaison for individuals to be dispatched on a long or short-term basis to the recipient country. In addition to the above activities, we also conduct other services to further mutual understanding among the Asian nations.

One of these activities in which we participate is the "Japan-China Civil and Commercial Law Seminar." This is a seminar where we provide an opportunity for the Japanese to understand China's legal framework as well as for the Chinese to understand the Japanese system. The seminar is convened once a year either in Beijing or Tokyo. This year [1999] in June, we convened our fourth seminar in Beijing. We had a great many participants from the Chinese government. We constructed an agenda in which the Chinese were particularly interested.

Moreover, we held a "Bankruptcy Law Symposium for Asia-Pacific Region Countries" and a "Seminar on Vietnamese Law." We invited academics and practitioners from Australia, Singapore, Malaysia, Thailand, Indonesia, China and Korea as lecturers. Furthermore, as a study project, we set up a research committee on The Study of Asian-Pacific Region Bankruptcy Laws.
Over the last year, we have compiled essays on the comparative study of bankruptcy law within Asia. This project is almost at its conclusion. This year we are looking into out-of-court settlement issues. Our intention is to study the topic based on actual cases. We are currently in the process of selecting members to conduct research in selected countries from this year to next.

We also have been collecting books and documents, and publish the ICCLC three times a year. It reports on symposiums and seminars, board of directors and trustee meetings, project plans, the budget, project reports and account settlements. Additionally, we publish The ICCLC NEWS four times a year to report on the Foundation's activities and related information regarding civil and commercial law for individual countries.
