Japan's Intellectual Assistance to Asian Nations Needs to
Include Constructing a Comprehensive System

Expansion of Needs


For now, Japan will concentrate its efforts on Vietnam and Cambodia.
However, it seems that other Asian nations are also in need of support to construct a new legal framework. Although at the present time, our focus is mainly on former socialist states, there are requests from countries such as Thailand and Indonesia, which have seen a rapid expansion of their economies and changes in their society, for assistance. In accordance with globalization, they too need to change their systems.
Initially, Vietnam sought our advice and guidance on civil and commercial matters (i.e., family registers, registrations, deposits, civil litigation law, civil procedural law, etc.).

Eventually, they also sought our adviceon financial crimes with the introduction of market-oriented economic reforms. Moreover, they sought cooperation and support in the areas of investment law, maritime affairs law and antitrust law.

At the same time, there have been requests to support regional economic integration activities for institutions such as the WTO, AFTA, ASEAN and APEC. Furthermore, with the initiation of the U.S.-Vietnam Bilateral Trade Agreement, Vietnam will need assistance in revising their commercial laws, intellectual property rights laws, antimonopoly laws and prevention of unfair competition laws.
Whenever a new demand arises, the Japanese government has taken measures to provide training.

For other Asian nations, excluding Vietnam and Cambodia, for example, we could provide support in limited legal fields such as property law instead of assisting with the whole of the legal framework. When we receive a request from a country, we could invite experts to cooperate with us as demand arises and we would do our best to provide long-lasting support.
We cannot force this type of assistance on other countries. The request must always originate from the recipient country. To expand this type of assistance project, it is necessary for Japan to maintain a structure which could respond to such requests.
